These Terms of Service establish the guidelines and conditions for using the Movies but Films website (referred to as the “Site”).

To access and use the Site or Services, you must be at least 18 years old. Minors may only use the Site or Services with adult supervision.

We may update these Terms of Service at our discretion. Any changes will be indicated by a new "Revised" date and will take effect immediately upon posting. It is your duty to check these terms periodically for updates. Continued use of the Site after changes signifies your acceptance of the revised terms. We also reserve the right to alter or enhance the Site to align with our evolving products, user requirements, or business goals.

Moreover, by agreeing to these Terms of Service, you confirm that you will not use the Site and Services for any unlawful purpose or any purpose that violates Movies but Films's policies. You may not use the Site and Services in a manner that may cause damage, disable, overload, or impair any aspect of the Site and Services or interfere with any other party’s ability to use the Site and Services.

Intellectual Property Rights

Copyright and other relevant intellectual property rights extend to all content on the Site, including all text relating to Movies but Films and any services We may provide. Movies but Films logo and any other content from the Site and Services may not be reproduced without Our consent.

Limitation of Liability

IN NO EVENT SHALL Movies but Films AND ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF Movies but Films SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM Movies but Films SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH Movies but Films SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA Movies but Films SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER ORNOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

YOU SPECIFICALLY ACKNOWLEDGE THAT Movies but Films SHALL NOT BE LIABLE FOR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

Movies but Films makes no representations that the Movies but Films services are appropriate or available for use in other locations. Those who access or use Movies but Films services from other jurisdictions do so at their own volition and are responsible for compliance with local law.

Indemnity

You agree to defend, indemnify and hold harmless Movies but Films, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Movies but Films services; (ii) your violation of any term of these Terms of Service; or (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right. This defense and indemnification obligation will survive these Terms of Service and your use of the Movies but Films services.

Ability to Accept Terms of Service

You affirm that you are either more than 13 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service.

Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by You, but may be assigned by Movies but Films without restriction.

Children

If you are the parent of a child under 13 years of age, please also read this Section.

If you are under 13 years of age, you may not use this Site unless your parents or your legal guardian have read all that is written here and told you it is OK to do so. If your parents or legal guardian have not done that, please ask them to do so.

Even if your parents or legal guardian have read and approved these Terms of Service, and your use of the online services, they must also read and approve the Privacy Policy found at Privacy Policy and you must not enter any personal information, such as your name, address, telephone number, hobbies or email until they approve that.

DMCA Policy

If you believe that you are the owner of the copyright or other rights in any material(s) appearing on Movies but Films, and/or that ownership of the copyright or other rights in any material has been incorrectly used or represented on Movies but Films, please contact us via legal@moviesbutfilms.comlegal@moviesbutfilms.com.

Upon receipt of Notice as described below, Movies but Films will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

DMCA NOTICE OF ALLEGED INFRINGEMENT (“NOTICE”)

1. Identify the copyrighted work that you claim has been infringed, or - if multiple copyrighted works are covered by this Notice - you may provide a representative list of the copyrighted works that you claim have been infringed.
2. Identify the material or link you claim is infringing (or the subject of infringing activity) and to which access is to be disabled, including at a minimum, if applicable, the URL of the link shown on the Site or the exact location where such material may be found.
3. Provide your company affiliation (if applicable), mailing address, telephone number, and, if available, email address.

General

You agree that: (i) the Movies but Films services shall be deemed solely based in Slovakia; and (ii) the Movies but Films services shall be deemed a passive service that does not give rise to personal jurisdiction over Movies but Films, either specific or general, in jurisdictions other than Slovakia. These Terms of Service shall be governed by the internal substantive laws of Slovakia, without respect to its conflict of laws principles. Any claim or dispute between you and Movies but Films that arises in whole or in part from the Movies but Films services shall be decided exclusively by a court of competent jurisdiction located in Bratislava. These Terms of Service, together with the Privacy Notice at moviesbutfilms.com and any other legal notices published by Movies but Films on the Site, shall constitute the entire agreement between you and Movies but Films concerning the Movies but Films services. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and Movies but Films failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. Movies but Films reserves the right to amend these Terms of Service at any time and without notice, and it is your responsibility to review these Terms of Service for any changes. Your use of the Movies but Films services following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. You and Movies but Films agree that any cause of action arising out of or related to the Movies but Films services must commence immediately after the cause of action accrues. Otherwise, such cause of action is permanently barred.
